This agreement is entered into between yourself and Locknlens, hereinafter referred to as the "Photographer," and "Service user", hereinafter referred to as the "Client," collectively referred to as the "Parties," for the provision of headshot and portrait photography services. By booking and utilising the services provided by the Photographer, the Client agrees to the following terms and conditions:
1. Services Provided:
The Photographer agrees to provide headshot and portrait photography services as agreed upon and detailed in the booking confirmation.
2. Booking and Payment:
A non-refundable package price fee is payable on the day of the booking. If agreed 50% of the agreed fee is payable on the day with the remaining balance due before release of the photos. Failure to make the payment may result in cancellation of the session.
3. Cancellation and Rescheduling:
In the event of cancellation and rescheduling by the Client, a non-refundable rescheduling deposit of 50% of the total fee must be made at least 2 days before the scheduled session, subject to Photographer's availability.
4. Copyright and Usage:
The Photographer retains the copyright to all images created during the session. The Client is granted a limited, non-exclusive, non-transferable license to use the images for personal and promotional purposes. Commercial use of the images requires a separate agreement and fee.
5. Image Delivery:
The final edited images will be delivered to the Client within 2 weeks of the agreed images selected by the client, unless otherwise specified. The Photographer is not responsible for delays caused by factors beyond their control.
6. Client Cooperation:
The Client agrees to cooperate with the Photographer's direction and advice pre, during and post session. Any decision not to cooperate may result in suboptimal results, and the Photographer shall not be held responsible for such outcomes.
7. Creative Control:
The Photographer retains creative control over the artistic aspects of the session, including but not limited to poses, composition, and editing styles.
8. Image Retouching:
Basic retouching is included in the package. Additional retouching requests may be subject to an additional fee agreed upon before the session.
9. Model Release:
The Client grants the Photographer the right to use images, for promotional purposes, including but not limited to website, portfolio, social media, and marketing materials unless agreed upon before final release of images to client.
10. Liability:
While utmost care will be taken in handling equipment and providing services, the Photographer shall not be liable for any damages, injuries, or losses caused during the session.
11. Force Majeure:
The Photographer shall not be held liable for any failure or delay in the performance of their obligations due to circumstances beyond their control, including but not limited to acts of nature, government restrictions, and technical failures.
12. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of The United Kingdom. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in The United Kingdom.
By proceeding with the booking you agree to these terms and conditions, the Client acknowledges that they have read, understood, and accepted all the terms outlined in this Agreement.
